Terms of Service

These Terms of Service ("Terms") govern your access to and use of Drifthost, the AI website builder and hosting service available at drifthost.site (the "Service"), operated by Drifthost ("Drifthost", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Acceptance of terms

By accessing or using the Service, you agree to be bound by these Terms and by our privacy practices. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization. If you do not agree to these Terms, do not use the Service. You must be at least 13 years old (or the minimum age of digital consent in your country) to use Drifthost.

2. Accounts and security

You are responsible for the information you provide when registering and for keeping it accurate. You are responsible for safeguarding your account credentials and any personal access tokens you create, and for all activity that occurs under your account. Notify us promptly at support@drifthost.site if you suspect unauthorized use. We are not liable for losses arising from your failure to keep credentials secure.

We may remove content or suspend accounts that we reasonably believe violate this section, and we may report unlawful activity to the appropriate authorities.

4. Your content and ownership

You retain all ownership of the sites, files, code, and other materials you create, upload, or deploy through the Service ("Your Content"). We do not claim ownership of Your Content. You grant us a limited, non-exclusive license to host, store, process, transmit, and display Your Content solely as needed to operate and provide the Service to you, including generating output through the AI editor. You are solely responsible for Your Content and for ensuring you have the rights to use and publish it. Output produced by the AI editor is provided as-is, and you are responsible for reviewing it before publishing.

5. Plans, billing, and cancellation

Drifthost offers a Free plan and paid plans (Pro and Studio) described on our pricing page. Paid plans are billed monthly in advance through our payment processor and merchant of record, Dodo Payments, which handles cards, invoices, and applicable taxes. Certain usage, including AI token overage on paid plans, is metered and billed in addition to the plan fee. You authorize us and our processor to charge your payment method for all fees incurred. Fees are non-refundable except where required by law. You may upgrade, downgrade, or cancel at any time from your billing page; upgrades take effect immediately and are prorated, and downgrades or cancellations take effect at the end of the current billing cycle. We may change prices with reasonable prior notice, effective at your next billing cycle.

6. Service availability and changes

We work to keep the Service available and reliable, but it is provided on an "as available" basis and we do not guarantee uninterrupted or error-free operation. We may modify, add, or remove features, and perform maintenance that may cause temporary downtime. We will make reasonable efforts to give notice of material changes that significantly reduce core functionality.

7. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Service in a way that risks harm to us, other users, or third parties. Upon termination, your right to use the Service ends and we may delete Your Content after a reasonable period; you are responsible for keeping your own backups. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and these general terms — will survive.

8. Disclaimer of warranties

The Service and all content and output are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, be secure, uninterrupted, or error-free, or that any AI-generated output will be accurate or suitable for your use.

9. Limitation of liability

To the maximum extent permitted by law, Drifthost and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or USD $50.

10. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
